Example of a Curve Breaker Agreement

 

Preamble

Consumption of electricity in the Danish public sector is growing annually by more than 1%. This rising consumption trend can be broken through targeted electricity savings initiatives. Public sector institutions can reduce their electricity bills by many thousands of Danish kroner through energy efficient purchasing and other energy savings initiatives. The Trust is therefore offering partnership agreements which will make it easier for public sector organisations and institutions to fulfil their energy savings potential.

Primary aim

The primary aim of a Curve Breaker Agreement between the Trust and [The Partner] is to reduce electricity consumption through the combined efforts of both parties. [The Partner] has agreed to save a specified amount of electricity before [date]. [The Partner] can decide how it wishes to achieve the savings during the period of the agreement, but must be open about the methods and must register with the Trust’s ‘Se Elforbrug’ (view electricity consumption) database, which publicises the electricity consumption of public sector institutions on the Internet. The Trust provides assistance to achieve the savings target by offering advice and the possibility of using the Trust’s tools for the duration of the agreement period.

Mutual obligations and rights

  • Both parties to the agreement shall work positively to implement the terms of the agreement.
  • Both parties to the agreement may publicise the fact that they have entered into such an agreement.

The Trust’s obligations

  • The Trust offers to support the efforts of the [The Partner] to achieve the electricity savings target agreed during the period [date] to [date] by providing advice and by making available the Trust’s tools and products. The scope and content of this free assistance from the Trust’s Customer Advice service is on the basis that the assistance can subsequently be documented in a separate action plan.
  • The Trust offers coaching, behavioural campaign material and a special energy saving promotional suitcase.
  • The Trust will work to ensure that efforts of [The Partner] are profiled in the media.

[The Partner]’s obligations

  • [The Partner] must implement the initiative in order to reduce the consumption of electricity by [size, and scope of reduction].

Examples of savings targets:

Annual savings of 2% measured in kWh in relation to 2006 for the period 2007–2010; Annual savings of 10% measured in kWh/m2 in relation to 2006 for the period 2007–2009; Annual savings of 5% measured in kWh/person in relation to 2006 for the period 2007–2011.

Examples of scope of savings:

Savings targets apply to all local/regional institutions; Savings targets apply to local authority schools; Savings targets apply to a particular hospital in the region; Savings targets apply to a local authority’s administration buildings.

  • [The Partner] must be registered with the Trust’s ‘Se Elforbrug’ (view electricity consumption) database in order to track electricity consumption for the duration of the agreement.
  • [The Partner] must publicise how savings have been achieved.

Duration of the agreement

The agreement is binding on signature. The agreement ceases on [date], but may be extended by mutual agreement.

Both parties to the agreement may request a renegotiation of the agreement in the event that: the targets specified are not achieved, or one or more of the partners fails to meet their obligations as agreed. In the event of failure to agree new terms both parties may terminate the agreement by giving three months notice.
