Tender for test and laboratory services to the Danish Electricity Saving Trust

1. Introduction
The information provided below briefly describes the tender to supply procedure.
The conditions which must be fulfilled in order to be short-listed to submit a tender are shown in Section 3.

2. Description of scope of tender
2.1 Introduction
The Danish Electricity Saving Trust (hereinafter referred to as ‘the Trust’) works to promote energy savings in Denmark to ensure a more efficient use of electricity in private households and the public sector. Read more about the Trust at www.savingtrust.dk
The Trust’s website includes a number of interactive product overviews which display products within the electrical equipment areas, including products such as energy saving bulbs, fridges, computers, and many others. The product descriptions are supplemented with information on electricity consumption and others areas of interest.
The Trust has developed its own Energy Saving Label which can be used by retailers and producers on products which fall into the category of being amongst the 20% most energy efficient products on the market in any given product category.
In many cases requirements have also been set in terms of quality and other consumer-relevant considerations.
In order to benefit from the use of the Energy Saving Label, a product must be listed on one of the relevant product overviews produced by the Trust as described above.
In the interests of safeguarding the Trust’s integrity it is important that information about products is correct at all times.
Information about products listed in these overviews is supplied by producers themselves, but the Trust carries out random testing of products to ensure the validity of the information provided. A number of products are selected and sent for testing at laboratories and test institutes.
2.2 Framework agreements and tasks
The tender will comprise making framework agreements with up to 10 suppliers.
The agreements on test and laboratory services are valid from the date of signing and expire on 31 December 2011, after which they may be terminated without notice.
Notwithstanding the above, the Trust has discretionary powers to extend agreements by a further 1 year following expiry of the original agreements.
The product categories comprising the main elements in the proposed framework agreements are:

In addition to the product areas mentioned above, the Trust will have the option to add new categories in line with developments.
The Trust does not require that candidates are experts within all the fields referred to, but applicants must describe the scope of their expertise within each area covered by their application, cf. section 3.1.3 below.
The tasks associated with carrying out tests and providing laboratory services under the 9 main products categories comprise carrying out the tests in relation to the standards and norms for the areas in question, as well as producing reports and holding discussions with the producers.
3. Formal and practical aspects of the tender
Expressions of interest should be made on the basis of the EU restricted tender procedure per the EU Procurement Directive. Contract notice was submitted to the Official Journal of the European Union (OJEU) on 09.01.2009 and was expected to be published in OJEU within one week following receipt.
Companies wishing to participate should register their expression of interest in order to be short-listed to submit a tender, cf. the procedures specified below.
Up to 15 companies will be pre-qualified before subsequently being invited to tender.
In the event of there being more applicants than the 15 planned, the pre-qualified companies will be selected amongst the best suited based on the information, cf. section 3.1.1 - 3.1.3 below.

For archiving purposes, expressions of interest including any accompanying pictures must be submitted in A4 format, or in a size foldable to A4.
3.1 Conditions for participation
The items listed below must be included in the expression of interest. For additional requirements and information, please refer to the full version of the public procurement notice.
- 3.1.1 Individual circumstances
- Description of company, including ownership status and number of employees.
For consortiums, the above information must be provided by all parties in the consortium. - 3.1.2 Economic and financial capacity
- Solemn declaration on debt to public authorities.
- Solemn declaration on final and conclusive judgement.
- Solemn declaration on environmental protection and health and safety at work.

- Full accounts for the previous 2 complete years. Companies which cannot supply accounts for the 2 years can document their economic and financial capacity in another way, e.g. by forwarding quarterly or half-yearly accounts, key figures for turnover and net capital, etc., or a declaration signed by a qualified accountant.
For consortiums, the above information must be provided by all parties in the consortium.
- 3.1.3 Technical capacity
- Overview of the company’s expertise and competencies to carry out tests under the 9 product categories.
- References for similar projects which have been completed within the last 24 months.
- References for specific test and laboratory services supplied to public sector not-for-profit clients within the last 24 months.
- Documentation for accreditation and possible certification. The documentation supplied should, where possible, be divided up per the 9 product categories.
- Description of possible international and transnational cooperation with producers, importers or other commercial parties based on the above-mentioned test categories.
For consortiums, the above information must be provided by all parties in the consortium.
